TERMS OF SERVICE

INTRODUCTION

These Terms of Service ("Terms") govern your engagement with Aleph Creative-Hub ("we", "us", "our"), a division of Gahn Eden (Pty) Ltd (Registration Number: 2015/272887/07), registered in the Republic of South Africa.

By engaging our services, you agree to be bound by these Terms. If you do not agree, please do not proceed with a project engagement.

SCOPE OF SERVICES

Aleph Creative-Hub operates across seven divisions:

• 01 Web, Email & Cloud - Website design, development, hosting, email setup, cloud infrastructure
• 02 Design & Brand - Logo design, brand identity, brand guidelines, visual systems
• 03 Documents & Publishing - Company profiles, business plans, proposals, reports, LaTeX documents
• 04 Video & Audio - Video production, animation, voiceover, audio editing
• 05 SEO & Marketing - Search engine optimisation, digital marketing strategy, content marketing
• 06 Software & SaaS - Custom software development, web applications, API development
• 07 Social Media - Social media management, content creation, campaign strategy

The specific scope of each project is defined in the quotation or proposal document provided before work commences.

PAYMENT TERMS

Standard Payment Structure

Unless otherwise agreed in writing, all projects follow a 50/50 payment structure:

• 50% upfront - due before work commences
• 50% on delivery - due upon completion and handover of final deliverables

Currency and Method

All prices are quoted in South African Rand (ZAR) unless otherwise specified. Payment may be made via bank transfer (EFT) to the account details provided on your invoice.

Late Payment

Invoices are due within 7 days of issue. Late payments may result in project work being paused until the outstanding balance is settled.

INTELLECTUAL PROPERTY

Client Ownership

Upon full payment, the client owns the final deliverables as specified in the project scope. This includes final design files, documents, and assets explicitly listed in the quotation.

Aleph Portfolio Rights

Aleph Creative-Hub retains the right to use completed work in our portfolio, website, social media, and marketing materials unless a non-disclosure agreement (NDA) has been signed prohibiting this.

Third-Party Assets

Where third-party assets (fonts, stock images, plugins) are used, licensing terms of those assets apply independently. We will inform you of any third-party licensing requirements.

Source Files

Source files (e.g., .ai, .psd, .fig, raw code repositories) are not included by default. Source file handover can be arranged at additional cost if required.

REVISIONS

All projects include two (2) rounds of revisions as standard. A revision round is defined as a consolidated set of feedback provided in a single communication.

• Revisions must be requested within 14 days of deliverable presentation
• Additional revision rounds beyond the included two may be quoted separately
• Scope changes (adding new deliverables or significantly altering the brief) are not considered revisions and will be quoted as additional work

PROJECT TIMELINE

Estimated timelines are provided in each quotation. These are subject to:

• Timely provision of client content, assets, and feedback
• Receipt of the upfront payment
• The complexity and scope of the agreed deliverables

Delays caused by late client feedback or content provision do not constitute a breach of timeline on our part.

CONFIDENTIALITY

We treat all client information, business strategies, and project details as confidential. We will not share your proprietary information with third parties without your written consent, except where required by law.

If you require a formal Non-Disclosure Agreement (NDA), we are happy to execute one before commencing work.

CANCELLATION

• Projects may be cancelled by either party with written notice
• If cancelled after the upfront payment, the deposit is non-refundable as it covers work already commenced
• If cancelled during the project, payment will be due for all work completed to date
• Completed deliverables will be handed over upon settlement of all outstanding fees

LIMITATION OF LIABILITY

Aleph Creative-Hub's total liability for any claim arising from our services shall not exceed the total fees paid by the client for the specific project in question.

We are not liable for:

• Indirect, consequential, or incidental damages
• Loss of business, revenue, or profits arising from the use or inability to use our deliverables
• Delays or failures caused by third-party services (hosting providers, domain registrars, print houses)
• Client-provided content that infringes third-party intellectual property rights

WARRANTIES

We warrant that:

• All work delivered is original or properly licensed
• We will perform services with reasonable skill and care
• Deliverables will substantially conform to the agreed specifications

We do not guarantee specific business outcomes, sales results, or search engine rankings as a result of our work.

GOVERNING LAW

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms or our services shall be subject to the jurisdiction of the South African courts.

CHANGES TO THESE TERMS

We may update these Terms from time to time. The latest version will always be available on this page. Continued engagement of our services following any changes constitutes acceptance of the updated Terms.
